MEDITERRANEAN FENCING CONFEDERATION


The National Fencing Federations of Algeria, Cyprus, Egypt, Spain, France, Greece, Italy, Malta, Principality of Monaco, Tunisia and Turkey, joined together in Marsala (Italy) on April 8, 2003, decided to regroup as an association regulated by the Italian law, and to adopt the following statutes:


STATUTES

 

ADOPTED AT THE TIME OF THE CONSTITUTIVE ASSEMBLY
FROM MARSALA ON APRIL 8, 2003

CONTAIN 1 - CONSTITUTION

Art 1 The National Fencing Federations of the Mediterranean basin, signatories of these statutes and the Federations which will        decide to belong, decided to form an association regulated by the Italian law, named

 

MEDITERRANEAN FENCING CONFEDERATION (Co.M.Es.).

 

Contain 2 - DEFINITION, AIMS, REGISTERED OFFICE, COMPOSITION

Art 2 The Confederation is a geographical group made up of the National Fencing Federations of the countries bordering the             Mediterranean sea, and only the countries being under the same geographical conditions will be able to make a request for         adhesion in the future.

 

Art 3 Its duration is unlimited.

 

Art 4 The purpose of Co.M.Es., is:
     4.5 The solidarity in the sporting activity between the belonging national fencing federations, in ensuring respect of national           identities and a common sporting policy within the framework of the FIE.
    4.6 Co-operation and the co-responsibility in common interests.
    4.7 The dialogue and the internal and external interaction allowing a source of knowledge deepening and development of the           fencing.
    4.8 The development of our sport ethics.

 

Art 5 Co.M.Es has, therefore, for goals:
     5.1 To promote and develop fencing around the basin of the Mediterranean.
     5.2 To ensure the friendly and technical mutual aid between the belonging Federations.
     5.4 To organise technical, administrative and training courses, and to create a staff of technicians and organisation which one           will be able to consult for the organisation of major fencing events.
     5.5 To organise the Mediterranean Championships reserved to the cadets and juniors.
     5.6 To organise, in collaboration with the International Federation of Fencing (FIE) “experimental” championships, opened to           the athletes of the adherent countries to the Confederation.
     5.7 To study and coordinate proposals relating to the organisation of the various federations.
     5.8 To take part in the FIE activities in accordance with its Statutes.

    Co.M.Es has a nonlucrative goal.
    Co.M.Es works towards its ends without consideration or discrimination of political, religious or social nature.

 

Art 6 Co.M.Es has its registered office at the President’s home. It can be transferred in any other country from the         Confederation by decision from the Extraordinary General meeting (AGE). For practical reasons the administrative office is         at the Secretary General’s home.

 

Art 7 The Confederation is made up of all Fencing Federations of countries bordering the Mediterranean which are recognised by         their National Olympic Committees, are affiliated with the International Federation of Fencing,, belong to the International         Committee of the Mediterranean Games (CIJM) and which will have adhered to the present statutes.

 

Art 8 All members commit themselves collaborating for the realisation of CO.M.ES aims and accept the Statutes and the Rules         Co.M.Es. They all deserve the rights which these Statutes confer on the members Federations of the Confederation.

 

Art 9 It is decided to organise any meeting or action which could allow the Confederation to achieve its goals.

 

Art 10 The member Federations commit to pay an annual contribution fixed by the Ordinary General meeting (AGO).

 

CONTAIN 3 - BODIES

Art 11 The bodies of Co.M.Es are:

     11.5 The Ordinary General Assembly (A.G.O.)
     11.6 The Extraordinary General Assembly (A.G.E.)
     11.7 The Executive Committee (E.C.)
     11.8 The President.

 

Art.12 The Ordinary General Assembly (A.G.O.)
          The A.G.O is the highest body of Co.M.Es. It is made up of delegates elected by their National Federations and, with           advisory voice, of members of the International Fencing Federation’s Executive Committee belonging to affiliated           federations. It is empowered to/for :

     12.8 approval of management reports of the past year,
     12.9 admission and exclusion of the member federations,
     12.10 election of the president and five members of the Executive Committee,
     12.11 fix the amount of the annual subscription,
     12.12 adoption of the action plan
     12.13 approval of the budgets and accounts,
     12.14 rule on all issues which are submitted to it by the member federations, or the E.C.,

     Deliberations of the A.G.O are valid only if more than half of the members, up to date of their contribution, is represented.
     Each federation representative has a voice. When a federation cannot send its own representative it will be able to give its      proxy vote to a delegate of another federation. A representative will not be able to hold more than one proxy vote.
     All the decisions are reached by a simple majority of votes cast, except for cases envisaged by the Statutes.
     The AGO meets at least one (1) time per year.


Art.13 The Extraordinary General Assembly (A.G.E.)
         An A.G.E can take place at the request of at least a third (1/3) of CO.M.ES members or on the Executive Committee (EC)          decision.
         It is qualified for the modifications of the Statutes or the dissolution of the Confederation.

 

Art 14 The Executive Committee
          The E.C. is composed of ten (10) members of different nationalities, including six elected by the A.G for six (6) years.
          The E.C. includes :
          - the President,
          
- seven (7) membres including one Vice President
          - A Secretary General
          - A Treasurer

     14.1 Any member candidature for the E.C. must be presented by his national federation.
     14.2 The election of the President and the seven (7) members of the E.C. is conducted by secret ballot.
     14.3 The President is elected first: the absolute majority is required from the first two rounds,
             relative majority from the third.
            Then the seven members of the EC are elected : the seven (7) candidates elected are the ones who received the greatest             number of voices. In the event of equality between two or several candidates, it will be necessary to proceed to an             additional round. In the event of the new equality, youngest is elected.
     14.4 At its first meeting, the E.C. elects from its group:

          - The Vice president

          - The Secretary general

          - The Treasurer
            They must be each of a different nationality also different from the 5 other members of the EC.

     14.5 The President of the F.I.E, is a member by rigth, with advisory vote on the EC
     14.6 The EC meets, on President’s convocation, according to the needs and at least three (3) times
            per year. Its decisions are adopted by a simple majority, the vote of the President being decisive in case of equality.
     14.7 In the event of resignation or death of a member of the EC it will be proceeded to a complementary election during the             following AGO.

 

Art 15 The President
      The President represents Co.M.Es in all the acts of the civil life and in a court of law.

      15.1 The President chairs the A.G and the E.C.
      15.2 The President decides with other members of the E.C. of the actions to be followed up to ensure realisation of the              confederal goals.
      15.3 He manages the expenditure.
      15.4 Any financial commitments, beyond 5.000 € must be signed by both the President and the Secretary General.

 

CONTAIN 4 - COMMISSIONS

Art 16 To ensure the good functioning of Co.M.Es., the E.C. set up commissions (ex: technical commission, refereeing       commission, propaganda commission, etc…).

 

CONTAIN 5 - FINANCES

Art 17 The financial year of Co.M.Es begins on October 1 and ends on September 30.

     17.1 The income of Co.M.Es is supplied by membership fees, the gifts accepted by
             E.C. and all resources generated by its activities.
     17.2 The Co.M.Es expenditures are the expenses necessary for the association’s administration,
             The President’s expenses (or the Vice-president’s ones when he represents the President). Each federation pays for its              members expenses relating to transportation and stays at the meetings.

 

CONTAIN 6 - HONORARY MEMBERS

Art 18 The CoMEs can include an honorary President, and honorary members, outside national federation.                                              The Titleof honorary President or honorary member can be given by AGO to any person who dedicated to the Mediteranean           Fencing for long , to thank this person, in order to ensure the CoMEs with person's wise advices.

 

CONTAIN 7 - GENERAL PROVISIONS

Art 19 The debates are held in French language.
          The official deliberations and documents are published in French language and traslated in English before transmitting them           to all the national Federations..
          Other languages can be used as working language to facilitate the communication between the member federations.

 

CONTAIN 8 – AMENDMENTS TO THE STATUTES, DISSOLUTION

Art 20 Only the A.G.E can amend the statutes.

      20.1 In the event of amendment proposals, the A.G must be convened three (3) months at least
             before the date of the meeting.
             The amendment proposals will have to appear in an appendix of the A.G.E. agenda and will have to be sent to all                          member federations at least one month before the meeting.
      20.2 The decisions are adopted by the two thirds (2/3) majority of votes cast.

 

Art 21 The dissolution of Co.M.Es can be declared by the A.G.E only by the three quarters (3/4) majority of the Confederation’s           members.

 

Art 22 In the event of dissolution, the goods having belonged to the Confederation will be transmitted to the FIE.
